2. Quotes, Pricing, and Payments
- Price Validity: Price quotes provided via our website, email, or phone are valid for the period stated on the official quote or invoice (typically 7 to 14 days) and are subject to change based on market equipment costs and fuel surcharges.
- Payment Terms: Full payment or an agreed-upon deposit is required prior to equipment dispatch or the commencement of custom fabrication work, unless formal credit terms have been granted in writing.
- Taxes and Fees: Clients are responsible for all applicable local, state, and federal taxes, permit fees, or toll costs associated with equipment delivery and transport unless explicitly included in the invoice.
3. Delivery and Delivery Site Requirements
- Client Site Responsibility: The client is solely responsible for providing a flat, hard, clear surface (such as packed gravel, concrete, or dry asphalt) capable of supporting heavy delivery vehicles and loaded/unloaded containers.
- Clearance Standards: Delivery areas must have sufficient overhead, side, and turning clearance free of utility lines, trees, fences, or structural obstructions.
- Site Inaccessibility: If a delivery driver cannot safely enter or unload at the delivery location due to uncoordinated site conditions, mud, narrow gates, or overhead obstacles, the delivery will be deemed unsuccessful. In such cases, the client will be assessed a dry-run fee and billed for necessary re-delivery attempts.
- Property Damage Disclaimer: AG Container Transport LLC and its contract drivers are not liable for damage to soft ground, lawns, driveways, underground utilities, or unmarked landscaping features resulting from heavy equipment entering the delivery location as directed by the client.
4. Container Inspection and Acceptance
- Inspection at Delivery: The client or an authorized representative must inspect the container upon arrival.
- Discrepancies: Any visible damage, structural defects, or variances from the order specifications must be noted on the delivery driver’s paperwork and reported to AG Container Transport LLC in writing within 48 hours. Failure to report issues within this window constitutes full acceptance of the unit as-is.
5. Custom Modifications and Orders
- Scope Approval: Custom container modifications (e.g., doors, windows, insulation, painting, cutouts) will proceed strictly according to the scope of work approved on the sales invoice/addendum.
- Non-Refundable Work: Once custom modification or fabrication work has commenced, associated deposits and material costs are non-refundable.
6. Cancellations, Returns, and Refunds
All cancellations, returns, and refund requests are governed by our Refund and Returns Policy. Key conditions include:
- Transport cancellations made less than 24 hours prior to dispatch or after dispatch are non-refundable.
- Approved physical returns are subject to return transport costs and restocking fees unless the return is due to an error on our part.
7. Limitation of Liability
To the maximum extent permitted by applicable law, AG Container Transport LLC, its officers, employees, drivers, and partners shall not be held liable for:
- Indirect, incidental, special, consequential, or punitive damages.
- Delays in transport caused by weather conditions, road closures, traffic accidents, mechanical breakdowns, or events beyond our reasonable control (Force Majeure).
- Loss of business revenue, missed project deadlines, or damaged contents stored inside sold or transported containers.
In all events, our total monetary liability shall not exceed the total amount paid by the customer for the specific product or service giving rise to the claim.
